These Terms govern your access to and use of the El Barrio App platform.

Welcome to El Barrio App. These Terms of Use ("Terms") govern your access to and use of the El Barrio App website, mobile applications, and services (the "Platform").

The Platform helps organisers list and manage events and helps attendees discover and access events. Unless explicitly stated otherwise, El Barrio App VOF is not the organiser of events listed on the Platform.

If you do not agree to these Terms, do not use the Platform. We may update these Terms from time to time; if changes are material, we will provide reasonable notice where appropriate.

Accounts

Registration

To use certain features, you must create an account and provide accurate information. You are responsible for keeping your account details up to date.

Security

You are responsible for maintaining the confidentiality of your login credentials and for activities under your account. Notify us promptly if you suspect unauthorised access.

Age

The platform is intended for users aged 16 and over. If you are under 16, you may not create an account or use the platform.

Termination

We may suspend or terminate access if you materially breach these Terms, misuse the platform, or create security/legal risk. Where reasonable, we will provide notice and a chance to remedy.

Acceptable Use

Permitted Use

You may use the platform to discover events, organise events, purchase tickets, and interact with features we provide, in accordance with applicable law and these Terms.

Prohibited Use

You must not: (a) break the law; (b) post misleading event information; (c) impersonate others; (d) distribute malware; (e) scrape or harvest data without permission; (f) interfere with platform operations; (g) attempt unauthorised access; (h) use automated access except where we explicitly allow it.

Content & Conduct

You are responsible for any content you submit. Harassment, hate speech, discrimination, or abusive behaviour is not tolerated and may result in removal and account action.

Organiser Responsibilities

If you create events, you are responsible for event accuracy, venue permissions, safety, legal compliance (including consumer and tax rules), and fulfilment of the event.

Payments, Fees & Refunds

Currency & Taxes

Prices are shown in EUR unless stated otherwise. Where applicable, VAT/taxes will be displayed according to the relevant rules before checkout.

Payment Processing

Payments are handled by third-party payment providers. By purchasing, you also agree to the provider's terms. We do not store full payment card details.

Service Fees

We may charge service fees (e.g., ticketing or organiser tools). Fees are disclosed before purchase. Whether fees are refundable depends on the applicable refund rules and the event policy.

Refunds & Cancellations

Refunds for tickets are primarily governed by the organiser's refund policy and applicable law. If an organiser cancels or materially changes an event, the organiser is responsible for communicating outcomes and refunds where due.

Consumer Note (Event Tickets)

Under EU/Dutch consumer rules, the 14-day withdrawal right generally does not apply to leisure services for a specific date/period (such as dated event tickets). Different rules may apply for undated vouchers or other products.

Platform Role & Event Listings

Intermediary Platform

El Barrio App provides a platform that helps organisers list and manage events and helps attendees discover and access events. Unless explicitly stated otherwise, El Barrio App is not the organiser of events listed on the platform.

Event Quality & Safety

Organisers are solely responsible for their events (including content, safety, legality, and delivery). We do not guarantee the quality, safety, or legality of events.

Check-ins & Ticket Scanning

If ticket scanning/check-in is used, we process attendance status to help organisers validate entry and manage capacity.

Liability

Availability

We aim to keep the platform reliable, but we do not guarantee uninterrupted or error-free operation. We may modify or discontinue features for legitimate reasons (e.g., security, compliance, maintenance).

Limits

Nothing in these Terms limits liability where it cannot be limited under applicable law (for example, liability for intent or gross negligence, or other non-excludable rights). Subject to that, our liability is limited to foreseeable damages and, where appropriate, capped to the fees you paid to us in the 12 months before the event giving rise to the claim.

Disputes & Governing Law

Governing Law

These Terms are governed by the laws of the Netherlands.

Courts

Disputes will be submitted to the competent courts in the Netherlands, unless mandatory consumer law provides otherwise.

Digital Services Act (DSA) Basics

Reporting Illegal Content

If you believe content on the platform is illegal, you can report it to us using our reporting flow or by emailing our designated contact. We will review reports and take action where appropriate.

Indemnification

To the extent permitted by law, if you breach these Terms or misuse the Platform and that causes harm to us or others, you agree to indemnify and hold El Barrio App VOF harmless from resulting claims and reasonable costs. This does not apply to the extent the harm was caused by our fault.
